Atlanta poll workers Ruby Freeman and Shaye Moss are asking a federal bankruptcy judge to issue an injunction barring Rudy Giuliani from continuing to make defamatory statements about them, reported Politico's Kyle Cheney on Friday evening.

"Undeterred by facts, logic, decency, professional discipline, court orders in multiple jurisdictions, a criminal indictment, a multimillion dollar jury verdict, or declaring bankruptcy as a result, Mr. Giuliani has entered year four of intentionally defaming Ms. Freeman and Ms. Moss — repeating the very same lies that Plaintiffs engaged in fraud during their service as election workers during the 2020 presidential election," said the filing.

Officials with the office of Arizona Attorney General Kris Mayes served Giuliani in front of nearly 100 guests at his 80th birthday celebration in the Palm Beach, Florida area.

She quote-tweeted a post Giuliani since deleted in which he wrote, "If Arizona authorities can't find me by tomorrow morning 1. They must dismiss the indictment; 2. They must concede they can't count votes." Mayes posted a screenshot of the tweet after it was deleted.

If nothing else, this demonstrates the importance of every single vote.

Mayes' predecessor - Republican Mark Brnovich - essentially punted on this case. His office did a lot of "investigating" into claims of election fraud (at the behest of Trump), but when they found nothing, buried their findings. He was never going to prosecute the fake elector scheme that happened on his watch. Abe Hamedeh, who ran for the seat when Brnovich was term-limited out, was even farther to the right, and a full-on Trump supporter and election denier. There was no way he'd prosecute this case.

The margin of victory was 280 votes.

Really.

Mayes made preserving democracy a key theme of her 2022 campaign and cast herself as a bulwark against a coup. She defeated election denier Abe Hamadeh by 280 votes, the narrowest margin in a statewide contest in Arizona’s history.

Shortly after taking office, Mayes released records of Brnovich’s investigation of election fraud. They showed his staff couldn’t find credible evidence of any widespread fraud, including leads provided by Cyber Ninjas, the Florida-based company heading the ballot review, and other conservative groups.

The head of the Special Investigations section under Brnovich summarized his department’s work this way in a September 2022 report released once Mayes took office:

“Of the 430 investigations, 22 cases were submitted for prosecution. Agents and support staff have spent more than 10,000 hours investigating allegations of voting irregularities and reviewing alleged instances of illegal voting submitted to our office by private parties. Some of the more high-profile matters involved Cyber Ninjas Incorporated, True the Vote, Verity Vote, and elected officials. In each instance and in each matter, the aforementioned parties did not provide any evidence to support their allegations. The information that was provided was speculative in many instances and when investigated by our agents and support staff, was found to be inaccurate.”

By March 2023, Mayes had opened an investigation into the fake electors matter that Brnovich left essentially untouched.

“I’m not certain that my predecessor did an investigation into the fake electors,” Mayes told the Arizona Mirror at the time. “I will investigate the fake electors’ situation, and I will take very seriously any effort to undermine our democracy. Those are the cases that I will take most seriously.”

Rudy Giuliani has agreed to never again publicly accuse two Georgia election workers of tampering with votes in the 2020 election, a false accusation that he has repeated frequently and that led to his bankruptcy.

With the agreement, Giuliani is forfeiting a yearslong verbal and legal battle he’s waged with the election workers, Ruby Freeman and her daughter, Shaye Moss. It also gives the women significant power to hold him accountable if Giuliani again publicly suggests they stole votes to hurt former President Donald Trump, which is not true.

A draft of the agreement filed in court Tuesday says Giuliani would be “permanently enjoined from publishing, causing others to publish, and/or assisting in others’ publication of any statements that suggest that Plaintiffs, whether mentioned directly, indirectly, or by implication, engaged in wrongdoing in connection with the 2020 presidential election.”

Here’s why he agreed:

The agreement includes Freeman and Moss dropping a second lawsuit they filed against Giuliani on the same day they won the $150 million judgment against him in December, because he continued to make false statements about them.
